Timeline for filing a workers’ comp claim

Missouri workers have the right to seek compensation for their medical bills and lost wages as the result of a job-related injury. However, following the proper timeline for filing a claim is imperative to receive the full amount owed.

Here is a timeline employees should follow to successfully file a workers’ compensation claim.

Seek medical attention first

If you work in the construction industry for a company with one or more employees, or for a company in any other type of business with five or more employees, your employer is required to provide for your medical treatment and care through a workers’ compensation insurance policy. You should make sure to receive the medical attention you need immediately, as putting off treatment could negatively impact your recovery.

Report an injury immediately

As soon as an injury happens, you should report it to your employer or supervisor. Failure to report an injury within 30 days can jeopardize your ability to receive any benefits, so this should be a first priority.

File the claim within two years

Injured workers have two years from the date of the injury to file a workers’ compensation claim with the Division of Workers’ Compensation. If an employer neglects to file a Report of Injury with the division in a timely manner, you may have three years from the date of the injury.

However, it is always best to file the claim as soon as possible to avoid the risk of missing benefits. Workers can receive assistance with the claims process and any issues with employers or insurance companies with the help of a workers’ compensation attorney.
