Personal injury claim may follow Illinois drunk driving accident

Most Illinois residents know someone who has been injured in an accident that was caused by a drunk driver. A victim of a drunk driving accident will likely be emotional and experience anger and may be considering the possibility of holding the intoxicated driver responsible. There may be questions about legal options and how to go about filing a claim.

A 48-year-old Illinois resident may be considering his options after he was recently involved in an auto accident that was allegedly caused by a drunk driver. The Illinois State Police reported that a 52-year-old driver was southbound on a road in Henderson County in the early morning hours of a recent Sunday morning. For unknown reasons, she reportedly crossed into the northbound lanes and smashed into a pickup truck.

The impact of the crash sent the two vehicles in opposite directions, and they came to a halt off the roadway. The 48-year-old pickup truck driver was taken to a Burlington medical center for treatment of the injuries he sustained. The driver who crossed over the center line was arrested after she refused medical treatment.

Police reportedly suspected the arrested driver to have been driving under the influence of alcohol. In addition to a charge of causing injuries in a drunk driving accident, other charges include inappropriate use of traffic lanes and driving an uninsured vehicle. Illinois residents who believe their auto accident injuries were caused by the negligence of others may pursue compensation for medical expenses. However, in order to file a personal injury claim in a civil court, sufficient evidence to substantiate the claim will have to be documented. Compensation for other losses sustained may be awarded in addition to medical expenses providing they are allowed under state law.
