Illinois pedestrian killed in car accident, no charges filed

Because pedestrians typically don't wear protective clothing when walking on Illinois roads or sidewalks, serious injuries or even deaths are not uncommon when they are hit by a vehicle. Even when the vehicle is not moving at a high speed, a pedestrian may be critically injured. When a motorist is not observant while driving, a car accident where a pedestrian is hit by a car could happen in an instant.

State police were called to an accident on a recent Thursday evening. The accident apparently happened at approximately 9:15 p.m. and involved an SUV and a pedestrian. It was reported that a 35-year-old female driver of an SUV was northbound on Route 49 when she struck a pedestrian. The victim was a 29-year-old male who was walking in a southern direction.

The pedestrian was critically injured and died at the accident scene approximately two hours after the collision occurred. An autopsy was planned for the next day. The media report stated that no criminal charges had been filed. The media report gave no indication of the possibility of alcohol being involved, or what other contributing factors may have played a part.

When Illinois residents lose a loved one in a car accident caused by the negligent actions of another party, they retain the right to file a wrongful death claim in a civil court. If the deceased person was the breadwinner of a family, they are likely to face financial difficulties. Apart from the loss of income, they will also be burdened with the high costs of final medical expenses and a funeral. When a claim in the civil court is presented successfully, the next of kin may receive monetary restitution to assist them with covering the expenses brought about by the accident, along with other costs deemed appropriate under state laws.
